PLEASE READ THESE TERMS CAREFULLY BEFORE USING PAYLUX. By accessing or using PayLux, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use PayLux.
1. Acceptance of Terms
By using PayLux (the "Service"), a Discord bot operated from Alberta, Canada, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Refund Policy. These Terms constitute a legally binding agreement between you and PayLux.
2. Service Description
PayLux is a subscription-based digital points system that allows users to:
Purchase virtual points using real money (via PayPal)
Transfer points to other Discord users
Withdraw points back to real money (via PayPal Payouts)
Points have no inherent value outside of the PayLux system. The exchange rate is fixed at 100 points = $1.00 USD.
3. Eligibility Requirements
To use PayLux, you must:
Be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher
Have a valid Discord account in good standing
Have a valid PayPal account in good standing
Have legal capacity to enter into binding contracts
Not be located in a jurisdiction where the Service is prohibited
We rely on Discord’s and PayPal’s age verification systems. By using PayLux, you represent and warrant that you meet all eligibility requirements.
4. User Account and Security
4.1 Account Creation
Your PayLux account is tied to your Discord User ID. By using PayLux, you automatically create an account in our system.
4.2 Security PIN
You are required to set a 4-digit security PIN to access certain features. You are solely responsible for maintaining the confidentiality of your PIN. Never share your PIN with anyone.
4.3 Account Security
You are responsible for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.
4.4 Account Transfer
You may not sell, transfer, or assign your PayLux account to any other person or entity. Any attempt to do so will result in immediate account termination.
5. Subscription Terms
5.1 Subscription Required
Access to PayLux features requires an active paid subscription. We offer three tiers:
Tribute ($3.99/month)
Commendation ($6.99/month)
Homage ($12.99/month)
5.2 Recurring Payments
Subscriptions automatically renew each month until cancelled. You authorize PayPal to charge your payment method on a recurring basis.
5.3 Cancellation
You may cancel your subscription at any time through your PayPal account settings. Cancellation takes effect at the end of the current billing period. No pro-rated refunds are provided for partial months.
5.4 Subscription Changes
We reserve the right to modify subscription pricing with 30 days’ notice. Price changes do not affect your current billing period.
6. Payments and Transactions
6.1 Payment Processing
All payments are processed through PayPal. By using PayLux, you agree to PayPal’s terms and policies. PayLux does not store your payment information.
6.2 Point Purchases
When you purchase points, you receive the exact amount you pay for (e.g., $25 = 2,500 points). Point purchases are final and non-refundable except as specified in our Refund Policy.
6.3 Withdrawals
You may withdraw points back to cash at any time, subject to:
Minimum withdrawal of 500 points ($5.00)
Your tier’s daily withdrawal limit
Applicable withdrawal fees (platform fee + $0.25 PayPal fee)
Valid PayPal email on file
Withdrawals are typically processed instantly but may take up to 24 hours.
6.4 Transfers
Point transfers between users are free and irreversible. You are responsible for ensuring you send points to the correct recipient. We cannot reverse transfers.
6.5 Daily Limits
Your tier determines your daily buy and withdraw limits. Limits reset at midnight UTC. Exceeding limits will result in transaction rejection.
7. Prohibited Activities
You may NOT use PayLux to:
Engage in or facilitate money laundering, fraud, or any illegal activities
Violate any local, state, national, or international law
Create multiple accounts to circumvent limits or restrictions
Use the Service for gambling, betting, or games of chance
Attempt to exploit, hack, reverse engineer, or manipulate the Service
Engage in chargebacks or payment disputes in bad faith
Harass, threaten, impersonate, or abuse other users
Use automated tools, bots, or scripts to access the Service
Violate Discord’s Terms of Service or Community Guidelines
Sell, rent, or commercialize access to PayLux
Use PayLux for any purpose other than its intended use
Violation of these prohibitions will result in immediate account termination and potential legal action.
8. Fees
8.1 Subscription Fees
Monthly subscription fees are charged in advance and are non-refundable.
8.2 Withdrawal Fees
Withdrawals incur a tier-based platform fee (3.5%–7.5%) plus PayPal’s $0.25 processing fee. Fees are clearly displayed before you confirm any withdrawal.
8.3 No Hidden Fees
We do not charge fees for point purchases or transfers between users.
9. Service Availability
PayLux strives for high availability but makes no guarantees. We reserve the right to:
Modify, suspend, or discontinue any feature at any time
Perform scheduled or emergency maintenance
Limit access during high-traffic periods
We are not liable for any downtime, service interruptions, or data loss. We will attempt to provide advance notice of scheduled maintenance when possible.
10. Account Termination
10.1 Termination by You
You may close your account at any time by contacting [email protected]. Withdraw your balance before closing your account, as closed accounts cannot be reopened.
10.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without notice, for:
Violation of these Terms
Fraudulent or suspicious activity
Chargebacks or payment disputes
Violation of Discord or PayPal policies
Any reason at our sole discretion
Upon termination for cause, your remaining balance may be forfeited, and you will not receive a refund.
11. Disclaimer of Warranties
IMPORTANT – PLEASE READ CAREFULLY:
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
PAYLUX DOES NOT WARRANT THAT:
The Service will be uninterrupted, secure, or error-free
The results obtained from using the Service will be accurate or reliable
Any errors will be corrected
The Service will meet your requirements
You use the Service at your own risk. No oral or written information or advice given by PayLux shall create a warranty.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYLUX AND ITS OPERATORS SHALL NOT BE LIABLE FOR:
Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Costs of substitute services
Any damages arising from your use or inability to use the Service
User error (e.g., wrong PayPal email, incorrect transfer recipient)
Third-party service failures (PayPal, Discord, internet providers)
Unauthorized access to your account
Service interruptions or downtime
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO PAYLUX IN THE 30 DAYS PRIOR TO THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless PayLux and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Your use of the Service
Your violation of these Terms
Your violation of any rights of another person or entity
Your violation of any applicable laws
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
14.2 Arbitration Agreement
Any dispute arising from these Terms or your use of PayLux shall be resolved through binding arbitration in accordance with the Arbitration Act of Alberta. You waive the right to participate in class action lawsuits.
14.3 Informal Resolution
Before initiating arbitration, you agree to attempt to resolve the dispute informally by contacting [email protected].
14.4 Chargebacks
Filing a fraudulent chargeback with PayPal instead of contacting us first will result in permanent account termination, forfeiture of all funds, and possible legal action for fraud.
15. Privacy
Your use of PayLux is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
16. Refund Policy
All sales are generally final. Refunds are only provided in specific circumstances as outlined in our Refund Policy. Please review our Refund Policy before making any purchases.
17. Taxes
You are solely responsible for determining and paying any applicable taxes on withdrawals or earnings in your jurisdiction. PayLux does not provide tax advice or issue tax documents. Consult a tax professional for guidance.
18. No Investment or Financial Advice
PayLux points are NOT securities, investments, financial instruments, or subject to investment regulations. This is a subscription service for virtual point transfers only. PayLux does not provide investment or financial advice.
19. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via Discord announcement or email. Your continued use of PayLux after changes constitutes acceptance of the modified Terms. Check these Terms regularly for updates.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
21. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PayLux regarding the Service and supersede all prior agreements and understandings.
